A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2013. 8. 29. 23:30경부터 2013. 8. 30. 00:50경까지 사이에 영주시 C에 있는 피고인과 피해자 D(여, 37세)가 함께 운영하는 E식당 내실에서 가게운영비 문제로 말다툼을 하던 중 화가 나 그곳 주방에 있던 흉기인 사시미 칼(칼날길이 약 21cm, 총길이 불상)을 들고 와 "며칠 전에 영주에서 내연녀를 칼로 찔러 죽인 일이 있는데, 너도 당해 봐"라며 피해자의 좌측 옆구리 부위를 1회 찌르고, 피해자의 휴대전화를 빼앗아 방바닥에 던지면서 “경찰에 신고하면 죽여 버린다. 가만히 있어라. 내가 오늘 밤에 너를 제대로 죽여줄게”라고 말하며 손에 들고 있던 사시미 칼로 방바닥을 쿡쿡 찌르다가 칼 손잡이가 부러지자 다시 주방에서 위험한 물건인 식칼(칼날길이 약 17cm, 총길이 약 30cm)을 가지고 와 피해자의 우측 얼굴부위를 1회 그어 피해자에게 약 2주간의 치료가 필요한 옆구리의 열린 상처 등을 가하고, 피해자 소유의 시가 3만원 상당의 장판을 손괴하였다.
