A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"The defendant, on July 20, 2016, 4694, sells S5 at the gallonce of "gallon" prepared by the defendant on the Internet in his/her residence in Sinsi City around July 20, 2016.

When sending money to the victim D who reported and contacted the notice, it was false to conclude that S5 mobile phones will be sent when galloning.

However, the defendant did not have S5 mobile phones when galloning, and even if he received money from the injured party, he did not have the intention or ability to sell it.

As such, the Defendant: (a) received KRW 104,00 from the Agricultural Cooperative (Serial number: E) in the name of the Defendant on the same day from the victim; and (b) received total amount of KRW 812,00 from the victims by deceiving the victims under the same veterinary method as indicated in the attached list of crimes from August 3, 2016, as well as from August 3, 2016.
