1. The Defendant is a person who operates a restaurant in the name of D City E in Gwanak-gu in Seoul Special Metropolitan City.

According to the evidence submitted by the Prosecutor, the fact that the Defendant, while running a restaurant business, received the supply of kimchi, etc. manufactured at the headquarters of “D urban community” that completed only a general restaurant registration without registering the food manufacturing business is recognized.

However, according to the records, the representative G of the headquarters of "D city" that supplied the defendant with old day kimchi, etc. was supplied to the defendant at the request of the chain shop owners including the defendant in this court, but did not know whether it would have to be registered for sale, and the fact of unregistered registration was not notified to the chain store owners, and the franchise store owners did not know the fact, and correspond to the defendant's change by stating that the franchise store owners did not know the fact. Although small scale scale is small, in light of the structure of the franchise business of "D city," the defendant is a legitimate "business owner" defined in Article 2 subparagraph 10 of the Food Sanitation Act, as defined in Article 2 subparagraph 10 of the Food Sanitation Act, or a legitimate "business operator" defined in Article 2 subparagraph 10 of the Food Sanitation Act, or a person who reported the business pursuant to Article 37 (1) or (4) of the same Act, or a person who registered the business pursuant to Article 2 (5) of the same Act.
