A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. From around 05:40 on August 13, 2014, the Defendant driven a Bsch Rexton car under the influence of alcohol concentration of about 1km at about 0.318%, without obtaining a driver’s license, from the roads near the mutual influence house located in the hot spring dong-dong, Busan, Geum-gu to the 2nd safety center located in the 506-3-dong, Geum-gu, Pung-gu, Busan, the head of which around that time runs without obtaining a driver’s license.
2. On August 13, 2014, the Defendant was required to present an identification card from a slope D belonging to the Geum-gu District C District District, which was dispatched after receiving a report, while stopping the said car at the center of the road along a three-distance intersection as set forth in paragraph (1) on August 13, 2014.
The defendant, who is a public document in possession, presented the first class ordinary driver's license for the defendant in the name of the Commissioner of Busan Local Police Agency, which is a public document in possession, as if the defendant was a driver's license for the defendant, and illegally displayed the official document.
3. Around 22:00 on August 13, 2014, the Defendant: (a) met the pro-Japanese Ha in front of the G restaurant located in Busan, Busan, and (b) the Defendant driven the said car under the influence of alcohol without obtaining a driver’s license as prescribed in paragraph (1); (c) the Defendant stated that “N was present at the police station at around 05:40, and talked with the police officer who driven the said car at around 05:40, while he was under the influence of alcohol, I would like to attract the police officer to attempt to flee; and (d) H appeared at the Busan, Geum-gu Police Station and the office located in Busan, Si-si, Busan, and had H attend the investigation of the said case, and set up an on the same road with the police station at around 25:40 on August 13, 2014, and made the Defendant attend the investigation and make the said case to make a false statement on the same day.”
