1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. On January 20, 201, the Plaintiff concluded an insurance contract on January 20, 201 (hereinafter “instant insurance contract”) with the Defendant and the insured as the Defendant, stating that the insured would receive hospital treatment as a general injury, or undergo surgery due to 16 major diseases, as prescribed by the terms and conditions, and that the insured would pay insurance proceeds in certain cases (hereinafter “instant insurance contract”).
B. After entering into the instant insurance contract, the Defendant received total amount of KRW 8,323,892 from the Plaintiff, as indicated below, for 317 days in total, 17 days after receiving hospital treatment due to disease, injury injury hospitalization, etc., from January 26, 2011 to December 17, 2012 due to the side of the conical signboard disability, and the base of the conical base (hereinafter “instant insurance accident”).
