A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On July 29, 2011, at around 15:00 on July 29, 201, the Defendant made a false statement to the victim D, stating, “A company,” which is a landscaping company run by himself/herself in Gyeonggi-gu, 200, KRW 20 million, which is due and payable at the national bank, shall be repaid. If a loan is granted in KRW 20 million, the Defendant will receive a repayment of the loan and return the loan in full after repaying the loan.”

However, the facts did not have the intention or ability to repay the above money even if the victim borrowed the above money.

The defendant obtained 20 million won on the day from the victim and acquired it by fraud.

2. On August 18, 2011, at around 10:00 on August 18, 2011, the Defendant made a false statement to the victim D’s “C Company” office stating, “Around 10:00, the Defendant purchased KRW 24,000,000 from KRW 20,000 to KRW 50,00,000,000, and supplied it to E Company, and may receive KRW 40,00,000 from KRW 50,00,00,000.”

However, even if the victim borrowed the above money from the victim, there was no intention or ability to purchase pine trees, and there was no intention or ability to repay the above money.

The defendant obtained 20 million won on the day from the victim and acquired it by fraud.

3. On April 30, 2012, the Defendant made a false statement to the victim D on April 30, 2012, stating, “In order to purchase from G, the landscape trees, the trees of which the party wants, 25gs, in order to purchase from G, the trees of which the party wants, the KRW 16 million is required at the value of the said pine trees. (b) the Defendant purchased KRW 16 million from G, on the face of the State, pine trees 25gs.”

However, in fact, the price of pine 25gs was a total of KRW 10 million, and the defendant was well aware of the above facts.
