Comprehensively taking account of the overall purport of arguments as to the cause of the claim Gap's evidence Nos. 1 and 2, the defendant who runs a reinforced concrete construction business, etc. on September 20, 2014, ordered the plaintiff, who is a construction business operator of the household facilities in Kimcheon-si, Kimcheon-si, to subcontract the construction cost of KRW 100,000,00 for the construction cost of the household facilities among the construction of the new aggregate and the civil construction works in Kimcheon-si, Kimcheon-si, and the construction cost of KRW 10,00,00 after the operation of equipment as an advance payment, and the payment of the remainder is made after the establishment of the underground slabst, and the construction cost is to be paid after the establishment of the first floor slab. The plaintiff completed the additional construction work in an amount equivalent to KRW 55,253,800 in accordance with an agreement with the defendant, and completed the construction work on November 20, 2014.

According to the above facts, the defendant is obligated to pay to the plaintiff the construction cost of KRW 105,253,800 ( KRW 55,253,800,000) and damages for delay calculated at the rate of 20% per annum under the Commercial Act from November 21, 2014, which is the following day after the plaintiff completed the construction, until July 8, 2015, which is the date when this decision is rendered, to the defendant's objection as to the existence and scope of the obligation, and the damages for delay calculated at the rate of 10% per annum under the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the following day until the day when the plaintiff completed the construction.

(1) The plaintiff's claim is justified within the scope of the above recognition, and the remainder is dismissed as it is without merit. It is so decided as per Disposition.
