Reasons
Basic Facts
A regional housing association (hereinafter “A housing association”) such as the conclusion of a construction contract agreement, is a regional housing association established by the head of Dongjak-gu Seoul Metropolitan Government and established by the head of the household without a house residing in Seoul Special Metropolitan City for at least six months (including the head of the household who owns one bond of 60 square meters or less in the exclusive residential area) to build a house, and is a housing association under the Housing Act established with the approval of the establishment of the head of Dongjak-gu Seoul Metropolitan Government on November 17, 2008 to implement a housing construction project (hereinafter “instant project”).
The Plaintiffs are the members of the A Housing Association.
On May 2007, the Defendant entered into an agreement in accordance with the mutual trust and good faith principle by setting the contract amount of KRW 70,411,565,00 for the instant project and the A Housing Association and the instant project as 30 months from the date of commencement of the actual construction work, and entered into a construction contract with the content that the terms and conditions of the authorization are satisfied and the design drawing is to enter into the construction contract agreement.
On July 15, 2007, the Defendant entered into a construction contract agreement with A Housing Association on the project of this case with the following contents:
The A Housing Association and the defendant, who are the project operator, shall conclude the construction contract agreement as follows, and prepare two copies of the construction contract agreement and keep one copy after signing and sealing it in order to verify it:
Article 1 (General Provisions) A Housing Association and the defendant shall implement the contents of this Convention in good faith through mutual cooperation in promoting a new project for the construction of multi-family housing and ancillary welfare facilities on the land of Dongjak-gu Seoul Metropolitan Government and 153 lots.
Article 2 (Opening of Business) The scale of business which is the basis of this Convention shall be as follows:
Provided, That the final scale of business shall be determined by the approval of a project plan (or approval for modification) from an administrative agency.
