A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person who violates the Pharmaceutical Affairs Act shall sell forged medicines, or store or display them for the purpose of sale;

Nevertheless, from November 201 to June 12, 2012, the Defendant aided and abetted the Defendant’s act of storing fake drugs for the purpose of selling fake drugs by storing them in the Defendant’s house upon D’s request, in order to assist the Defendant’s awareness that he/she had the storage of fake drugs for the purpose of selling them in the adult product store, such as fake 38,484, and fake 9,244, in which he/she contains the composition of “definite” as a prescription drug, and fake 38,484, and fake 9,244, in which he/she is aware that he/she had the storage of them for the purpose of selling them in the adult product store.

2. The Defendant is prohibited from possessing, using, transporting, administering, selling, giving or receiving, or delivering, a psychotropic drug, a psychotropic drug, as he/she is not a person handling narcotics.
