Defendant shall be punished by a fine of KRW 10,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant of "2018 High 863" is the representative director of the C corporation in Geumcheon-gu Seoul Metropolitan Government, Geumcheon-gu, and the third floor, who ordinarily employs 10 full-time workers and engages in the cryp franchise business.

1. When a worker dies or retires, the employer shall pay the wages, compensations, and all other money or valuables within 14 days after the cause for such payment occurred;

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant did not pay the total of KRW 16,012,00 for five workers as well as KRW 3,244,000 for June 2017, 2017, which was retired from the Defendant’s office, as well as KRW 16,012,00 for five workers, as in the list of crimes committed by Haban and E after childbirth located in Do Government-si, from February 22, 2016 to July 31, 2017, without any agreement between the parties on the extension of payment date.

2. An employer shall, when a worker dies or retires, pay the retirement allowance within 14 days after the cause for such payment occurred;

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant did not pay 10,791,224 won, including F's retirement pay 5,683,244 won, which was retired as a worker, within 14 days from the date of retirement without any agreement between the parties on the extension of payment deadline, as in the list of crimes attached thereto, from February 22, 2016 to July 31, 2017, when the Defendant worked as a part of the part-time manager, from the D after childbirth and E after childbirth located in the Gu Government-si, to the end of July 22, 2017.

Defendant 2, “2018 Highly 8666,” is the representative director of the Gu Government G and D Masan G in the sixth floor, who ordinarily employs 20 full-time workers and operates the pre-industrial kitchen.
