A defendant shall be punished by imprisonment for six months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, from July 11, 2012 to January 10, 2014, is a person who has been in charge of the disbursement of public charges, such as health insurance, income tax, and public officials pension, while performing an affair of assisting a disbursement officer, etc. in the branch of the Gangseo branch branch branch of the Chuncheon District Court.
1. On February 2013, the Defendant assumed a guarantee liability with respect to approximately KRW 100 million of the Defendant’s obligation owed by the mother of the Defendant to the neighboring branch, and, on February 2, 2013, the Defendant received demand from the above creditors for repayment of the obligation, and the Defendant arbitrarily withdrawn the money owned by the victim of the Republic of Korea deposited in the court account managed by the Defendant in his/her duties in the Gangnam District Court’s branch branch branch office, and used it for the purpose of paying the obligation, living expenses, etc.
On February 20, 2013, the Defendant voluntarily disbursed KRW 12,54,00, out of the amount deposited in the bank account (scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scop scops, living expenses, etc. around that time, from November 21, 2013 to July 30, 2019, then withdrawn KRW 12,54,000 in cash for personal use as shown in the attached Table 29 (1).
As above, the Defendant embezzled the victim’s property in the course of business.
2. The Defendant forged a private document at the office of the Gangseo-si branch court of the Chuncheon District Court located in 3288-18, as Gangnam-si, Gangnam-si, 2013, with a view to concealing the crimes as referred to in the above 1.3 above, the health insurance, income tax, and income tax of the employees of the above court.
