The prosecution of this case is dismissed.

1. The Defendant and the victim B (year 22) of the instant facts charged are students enrolled in the same department of C University and are living together in the dormitory of the same university.

On September 13, 2018, around 07:30 on September 13, 2018, the Defendant used the 5th floor of the C University dormitory located in Yongdo-gu, Busan, for the model model of the victim's hallway which has been abandoned in the corridor garbage tank, and used it as the part of the victim, and used the victim's chest part twice as the part of the dispute with each other.

2. Determination

(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;
