Punishment of the crime

1. Defendant A is a person in charge of safety and health management of Defendant B Co., Ltd. located in Ulsan-gu, Ulsan-gu.

The business owner shall protect the charging parts of electric machinery, apparatus, or street, etc. that are in danger of electric shock by having contacted or approaching the charging parts of electric machinery, apparatus, or street due to work, passage, etc. by means of installing a protective net or an efficiencies with sufficient smoke-proof effects to prevent a power shock, etc.

Nevertheless, from June 12, 2014 to June 13, 2014, the Defendant did not take protective measures, such as not installing a protective network or a divers for the charging unit in the small-sized electric charging box in the said place of business.

Accordingly, the Defendant did not take the safety measures necessary for the prevention of danger caused by electricity in operating the business.

(b) Where a business owner installs a safety signal in order to prevent workers from falling, etc., he/she shall install a structure comprised of upper rail lines, middle rail lines, end rail plates, and rail columns, and install a structure reinforced with sufficient strength protection measures, such as a safety signal pole, fence, vertical fall net, or cover, at a place where workers might fall down, as the end or opening part of the work launching and passage;

Nevertheless, the Defendant did not take preventive measures at the above time and place, such as installing an intermediate sckes between three safety difficulties, such as B22 tank front stairs, B24 tank rear stairs, B21 tank front stairs, etc., and installing a safety sckes at four places, such as the end of the d33 tank upper part of the 8-meter high-quality D3 tank, and the end of the 2.3-meter high-quality fuel storage tank: the end of the 22 and B24 tank, the end of the passage of stairs at a height of approximately 1.24 meters between B2 and B24 tank, and the end of the stairs passage, the height of which is about 1 meters adjacent to B22 tank, etc.

Accordingly, the Defendant may fall during work.
