Defendants shall be punished by a fine of KRW 1,500,000.

The Defendants did not pay each of the above fines.

Punishment of the crime

Defendants are workers who worked in Q Q Co., Ltd. (hereinafter referred to as “ Q”) operated by P with L, M, N, andO.

As Q’s management deterioration and Q’s auction procedure for real estate rent on the site and building of the above Q was conducted, the said 13 workers including the Defendants, even though Q received all wages from Q, prepared a written petition as if Q were not paid the last 3 months’ wages, submitted the document as if Q had not been paid for the last 3 months’ wages to the Jinju District Office, and then submitted the written petition to the Jinju District Office. Based on this, the said Q’s demand for payment of wages during the auction procedure for the real estate rent and sale to receive dividends equivalent to the last 3 months’ wages.

1. On April 3, 2014, the Defendants, L, N, andO submitted a petition under the name of the Defendants, L, M, N, andO, according to the contents of the public bid as above. L, around April 30, 2014, stated to the Jin-si Office of the Busan Regional Employment and Labor Agency that “I would punish P in the event of unpaid money and valuables, since 13 workers, including themselves, worked in Q of P management and retired on April 1, 2014 while making a true supplementary statement at the Jin-si Office, “P would not be punished since 114,192,00 won was not paid for the total wages of 3 months for workers.”

However, in fact, the said 13 employees, including the Defendants, received total of KRW 114,192,00,00 from Q in total.

After all, the Defendants submitted false complaints in collusion with L, M, N, andO for the purpose of having P be subject to criminal punishment.

2. On May 20, 2014, the Defendants, together with L, M, N, andO, retired from Q to April 1, 2014, 13 workers, including the Defendants, including the Defendant, at Changwon District Court 31-gil, Changwon-gun, Chungcheongnam-gun, Changwon-gun, Seoul.
