The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal in the judgment of the court below (the fine of KRW 5,00,000) is deemed to be too unhued and unfair.

2. In light of the fact that the crime of this case is not good, the court below determined the punishment by comprehensively taking into account the defendant's age, character and conduct, environment, motive, means and consequence of the crime, circumstances after the crime, etc. The above sentencing of the court below is reasonable, and the prosecutor's assertion is without merit, since it is judged that the above sentencing of the court below is appropriate.

3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
