The appeal is dismissed.

The grounds of appeal are examined.

For the reasons indicated in its holding, the lower court upheld the first instance judgment that acquitted the Defendant on the ground that it constitutes a case where there is no proof of crime regarding the violation of public documents among the facts charged in the instant case.

In light of the record, the lower court did not err by misapprehending the legal doctrine on the certification of a public offering relationship or by misapprehending the rules of logic and experience.

On the other hand, the prosecutor appealed against the guilty portion of the judgment of the court below, but there is no evidence of objection in the petition of appeal or the statement of reason for appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
