A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

In around 2011, the Defendant entered into an entrustment sale agreement with a construction materials manufacturing company D, such as a man-building block, and sells and supplies construction materials, such as man-building block, to landscaping construction works ordered by government offices and the Korea Land and Housing Corporation (hereinafter “LH”) (hereinafter “LH”).

1. Around December 2012, the Defendant provided money and valuables related to the supply of the 1st Section of the Kimcheon Innovation City: (a) sought advice from the LH Daegu Northern District Headquarters Facilities Business Department E, which was known to the general public from LH Daegu Northern District Headquarters; (b) in relation to the 1st Section of the Kimcheon Innovation City, he received from D to the LH Daegu Northern District Headquarters, in relation to the 1st Section of the Kimcheon Innovation City, which was ordered by the LH Daegu Northern District Headquarters; and (c) around that time, at the coffee shop near the dwelling of the F apartment of the Daegu Northernbuk-gu, Daegu Northern District; and (d) discussed to the effect that “E will help you deliver D products to LH.”

On December 24, 2012, the Defendant entered into a contract (contract amounting to KRW 1,052,349,080) with LH Daegu Northern District Headquarters and Kimcheon Innovation City, which supplies man-building block (contract amounting to KRW 1,052,349,080) to the 1st Section of the Kimcheon Innovation City, and supplied man-building block to the Landscaping Corporation in order from December 24, 2012.

In this regard, around December 2012, the Defendant issued 2,00,000 won in cash to E in return for the supply of landscaping works for the first section of Kimcheon Innovation City at the coffee shop near the residence of E, and around January 2013, KRW 15,00,000 in the Defendant’s car parked near the above apartment, and around March 2013, KRW 272 in the Defendant’s car parked in the public parking lot near the Daegu Seo-gu Seoul Northern District Headquarters of the Republic of Korea, Daegu, and KRW 20,000 in the Defendant’s car parked in the public parking lot near the above apartment.

Accordingly, the Defendant granted 37,00,000 won to LH staff E who is deemed a public official, in return for the supply of landscaping construction works in one section of Kimcheon Innovation City.

2. The Defendant offering money and goods related to the supply of goods, such as landscaping works for the restoration of the waterways in the east Port, shall continue to be the contract price for landscaping works for the restoration to the port through E around May 2013 with the headquarters of the Daegu Northern Sea Area Headquarters of LH and the waterway restoration to the port in the east Port.
