A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

On May 10, 2013, the defendant was sentenced to four years of imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes in Seoul High Court on the Aggravated Punishment, etc. of Specific Economic Crimes, and the judgment became final and conclusive on September 26, 2013.

The Defendant is a person who served as the representative director of C from January 201 to April 2011.

1. Preparation of private documents for qualification solicitation;

가. 자격 모용 금전소비 대차 계약서 작성 피고인은 2010. 6. 28. 경 부산 동구 D에 있는 C 본점 사무실에서, 주식회사 햄튼으로부터 돈을 차용하기로 하면서 피고인의 자녀인 E, F, G을 차용인으로 포함시켜 피고인이 50,000,000원, E이 421,381,020원, F이 421,381,020원, G이 421,381,020원 총 합계 1,314,143,060원을 차용하기로 하는 금전소비 대차계약을 체결하기로 한 후 위 E 등으로부터 위와 같은 금전소비 대차계약에 대한 승낙이나 위임을 받은 사실이 없음에도 차용인을 ‘ 을 (A 외 3’ 로 표시하고, ‘ 주식회사 햄 튼 과 을을 대리한 A 간에 위와 같은 내용의 금전소비 대차계약을 체결하기로 한다’ 는 취지로 기재된 금전소비 대차 계약서 하단의 ‘ 을‘ 란에 피고인의 이름 ’A‘ 을 기재하고, 그 옆에 피고인의 인감도 장을 날인하였다.
