Reasons
Punishment of the crime
[criminal power] On May 24, 2017, the Defendant was sentenced to ten months of imprisonment for fraud in the Dong branch of the Busan District Court, and completed the execution of the sentence in the Busan District Court on January 13, 2018.
【Criminal Facts】
1. The criminal defendant against the victim B was unaware of the chairperson of the Trade Union and Labor Relations Commission and was unaware of his/her intention or ability to arrange employment in C. However, on January 8, 2019, at the E sales outlet located in Seo-gu, Busan in Busan in order to have him/her find employment as the chairperson of the Trade Union and Labor Relations Commission. The defendant provided false statements to the victim and received 1.6 million won from the victim for job placement on January 24, 2019, as well as received 2.5 million won from the above E sales outlet around February 13, 2019; 5 million won from the 18th day of the same month; 6 million won from the 21st day of the same month; 2 million won from the 204th day of the same month; 3 million won from the 25th day of the same month; 3 million won from the 25th day of the same month; and 300,000 won from the victim’s account under his/her name.
Accordingly, the defendant was given 24.6 million won by deceiving the victim.
2. Fraud against victim H;
A. On January 25, 2019, the Defendant made a false statement to the effect that the Defendant is not a corporation I representative director, and even though he did not have the intent or ability to purchase a building under the name of the said corporation, the Defendant acquired KRW 500,000,000 from the victim of the K real estate in Seo-gu Busan, Seo-gu, Busan, stating, “In order to purchase the company building, KRW 200,000,000 from the company to the commission, and KRW 5,000,000,000,000,000,000,000,000 won from the company after concluding the contract in cash.”
B. Although the Defendant did not have any intention or ability to arrange employment in C by lack of a child among the union members, the Defendant is in the K Real Estate located in the Seo-gu Busan High Court around January 26, 2019.
