Based on its stated reasoning, the lower court upheld the first instance judgment that acquitted the Defendant on the ground that there was no proof of crime regarding the indecent act by compulsion among the facts charged in the instant case.

The judgment below

In light of the records, the above determination by the court below is acceptable, and contrary to the allegations in the grounds of appeal, there were no errors in the misapprehension of legal principles as to the meaning of indecent act in the crime of indecent act by compulsion.

Meanwhile, although the prosecutor appealed to the entire judgment of the court below, it did not state the grounds for appeal as to the guilty portion, nor did it state the grounds for objection in the appellate brief.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
