Reasons
Punishment of the crime
From March 2016 to June 2016, the Defendant, the victim C, and the victim D had been operating the real estate brokerage office as a partnership business in Gangseo-gu Seoul Metropolitan Government E building 112 and the first floor 107 of the former F building from March 2016 to June 2016, the Defendant and the victims had been willing to send documents requesting the victims to suspend the payment of transaction fees to the victims in order to receive the settlement of their funds after withdrawal from the partnership.
On June 9, 2016, the Defendant: (a) received KRW 10 million as the floor premium when opening a real estate brokerage office under subparagraph 112 of Article 112 of the E building; (b) transferred real estate located in the E building 112, which is well operated by the victim C, to I for a long time to a long time female real estate agent I for the victims of H real estate; (c) incurred loss of KRW 10 million by the victims; (d) the real estate brokerage office of the newly relocated F building 107, the real estate broker office of the victim, which was purchased by J through brokerage of the victims, was responsible for the victims; and (e) the victim was paid KRW 50 million from J to the tenant; and (e) the victim did not implement the agreement with the Defendant and the victim as the personal partner for the purpose of operating the business; and (e) the said victim did not perform the agreement.
H Transfer of real estate office to the above commercial building without disclosing its operating status, such as causing damage to the defendant by the person operating the business, and thus, the victim C would not be paid a transaction fee, and then the document was sent to K and L by registered mail at the Seoul Gangseo post office on the same day.
However, in fact, the victim C does not receive KRW 10 million from the same business property under the name of floor premium at the time when the victim C opens the E building 112, and the above commercial building is a separate transaction relationship with C.
