1. The Defendant’s KRW 50,000,000 as well as the Plaintiff’s annual rate of KRW 9.6% from February 20, 2012 to January 8, 2015.
Reasons
1. Indication of claim;
A. On November 20, 2010, the Plaintiff lent KRW 50,000,00 to the Defendant with interest rate of KRW 9.6% per annum (one million per month) and due date of payment on June 30, 2014. The Defendant did not pay the leased principal and interest after February 20, 2012.
B. The Plaintiff seek against the Defendant the payment of the amount of KRW 50,00,000,00 for outstanding loans, and damages for delay calculated at the rate of 9.6% per annum, which is the agreement rate from February 20, 2012 to January 8, 2015, which is the delivery of a copy of the complaint of this case, and 20% per annum as stipulated in the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings from the following day to the date of full payment.
2. Judgment by service (Article 208 (3) 3 of the Civil Procedure Act).
