A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 02:40 on April 7, 2015, the Defendant was subject to separate notice from the Victim F (F, 26 years of age) located D’s EMour 309, and the Defendant was subject to separate notice from the victim F, who was in an internal relationship with the Defendant, and led to a dispute with the victim.

Accordingly, the defendant detained the victim for about 2 hours and 20 minutes.

On April 7, 2015, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (hereinafter “Special Cases Concerning the Punishment, etc.”) (hereinafter “Ameras”), i.e., Emeras 309 from around 02:40 to 05:0, and 209 from around 02:0, as described in the foregoing paragraph (1), was exempted from all the clothes of the victim, and continuously taken the victim’s personal body on several occasions using the Defendant’s cell phone camera.

Accordingly, the defendant taken the body of the victim who could cause sexual humiliation or shame by using a camera, against his will.

3. The Defendant committed indecent acts by compulsion by compulsion, taking advantage of the circumstances in which the Defendant cannot resist, such as the time, place, and the victim’s hand and hair as described in the foregoing Paragraph (2) are forced to be bound, etc. as stated in the foregoing Paragraph (1), the Defendant met the victim’s chest by hand and fit the victim’s face.

Accordingly, the defendant forced the victim.
