1. Busan District Court Decision 98Ha21 delivered on the bankruptcy claim against the defendant's bankrupt's portdo comprehensive financial company.

1. The following facts may be found either in dispute between the parties or in full view of the respective entries and arguments set forth in Gap evidence Nos. 1, 2, and 3 (including paper numbers):

After the defendant opened a comprehensive custody passbook with the bankrupt's port comprehensive financial company (hereinafter referred to as the " bankrupt"), he purchased 114,00,000,000 won in total, including a promissory note with the face value of KRW 9,00,000,000 issued by Samsung General chemical company, from the bankrupt, at least 14 times in total (hereinafter referred to as the "purchase Promissory Notes"), and had the bankrupt keep the same in the way of depositing it into the comprehensive custody passbook issued by the defendant under the name of the bankrupt without being delivered the real (hereinafter referred to as the "Purchase Promissory Notes").

After that, the bankrupt, who was requested by the defendant to withdraw the purchase bill which comes due from the defendant, had already presented a payment proposal to each issuing company, and had already delivered the bill totaling KRW 114,00,000,000 to the face value issued by other companies, such as neglecting to distribute the bill instead of collecting the bill.

B. Of the bills issued on May 8, 2001 in lieu of the instant purchase bills, the sum of face value of the bills that were not recovered at the time of May 8, 2001 (hereinafter “instant issued bills”) is KRW 52,130,000,000, and the face value of the bills issued by the Defendant, among the issued bills, is KRW 3,200,000,000.

C. Meanwhile, on February 17, 1998, the bankrupt was subject to the disposition of revocation of business authorization by the Minister of Finance and Economy, and the same year.

9. On July 14, 2000, the Plaintiff was declared bankrupt by Busan District Court 98Ha21 (hereinafter “instant bankruptcy”). On March 20, 201, the Plaintiff was appointed as the bankruptcy trustee.

The defendant reported the total amount of KRW 55,631,965,507 of the issued bill of this case as bankruptcy claim, and the bankruptcy trustee denies all of them on the claim inspection date executed on December 23, 1998.
