A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a certified judicial scrivener from January 199 to September 2015 who operated the “A certified judicial scrivener office” in Seocho-gu, Seoul. The Defendant is a certified judicial scrivener from January 1, 2011 to September 2015; F from January 2012 to January 2016; G from August 2013 to November 2015; H from March 2014 to November 2015; I (J before the opening of name) paid the so-called “self-determination value” each month at the said A certified judicial scrivener office from January 2015 to March 2016; and K is a “individual rehabilitation” who handles legal affairs related to individual rehabilitation, bankruptcy, immunity, etc. as non-qualification.

No one, other than an attorney-at-law, shall accept or promise to receive money, valuables, entertainment or other benefits or shall provide or promise to provide such things to a third party, in compensation for providing appraisal, representation, arbitration, settlement, solicitation, legal consultation or preparation of legal documents or other legal services with respect to cases of litigation, non-contentious cases, household conciliation, cases or other general legal cases.

Nevertheless, the Defendant, such as E, F, G, H, I, and K, may use his name to deal with legal affairs, such as personal rehabilitation, exemption, bankruptcy, etc. In addition, the Defendant received so-called “self-determination value” from the above “individual rehabilitation hub” and the above “individual rehabilitation hub”, such as E, etc., was placed in the office of a certified judicial scrivener of A, thereby having independently accepted the case by giving an advertisement that deals with cases such as personal rehabilitation, bankruptcy, and immunity, and received the fees from the clients, and conspired to comprehensively handle a series of legal affairs, such as preparing documents in the name of the Defendant on behalf of the clients, and submitting them to the court.
