Punishment of the crime

1. Defendant A recommended G with the knowledge of common sense that “I would receive a loan as security for an apartment,” and H would lend the registration name of two households of I apartment purchased by He.

On June 28, 2011, G with A’s recommendation received from H as collateral 809 of the above apartment house, and immediately after having received a loan from the Seongbuk Saemaul Fund Depository, the registration of ownership transfer was completed under the name of G pursuant to the title trust agreement on the same day, and the two households of apartment purchased by H were transferred to G under the name of G, and in return, received from H the total amount of KRW 2.5 million per household as shown below.

Accordingly, the Defendant conspired with G and registered the real right to real estate in the name of the title trustee according to the title trust agreement.

2. Defendant B agreed to receive KRW 3 million per household from H on June 7, 201, and agreed to receive KRW 111,2602 per one household under the name of his wife, and completed the registration of ownership transfer under the above J’s name on the same day immediately after having received a secured loan from the Kimhae Agricultural Cooperatives as security, and received KRW 30 million in return for the completion of the registration of ownership transfer under the above J’s name as set forth below.

Accordingly, the Defendant registered the real right to real estate under the name of the title trustee according to the title trust agreement.
