The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for not less than two years and six months.

except that, for a period of four years from the date this judgment becomes final and conclusive.

1. The decision of the court below on the summary of the grounds for appeal (two years and six months of imprisonment and confiscation) is too unreasonable.

2. The instant crime was committed by the Defendant on October 2012, as the head researcher of H business division control team of the Victim El Electronic Co., Ltd. (hereinafter “victim”) around the end of October 201, and was under the management of the development of I’s hardware, and was subject to the Skypt proposal from Medidian, a major subsidiary of China, on April 12, 2013, between the Defendant and Medidian on April 2, 2013

From March 28, 2013 to April 16, 2013, immediately before entering into an employment contract with a main contractor from March 28, 2013 to April 16, 2013, immediately after entering into the above contract, the fact that the damaged company’s trade secret is maintained, and the defendant violated his/her duty to keep confidential management, and then printed out the document of “M”, stating the requirements for development of software that is the trade secret data of the victimized company in the computer hard disc office, which is the trade secret data of the victimized company, into A4 paper as stated in the judgment of the court below, with a total of seven documents as shown in the list of crimes Nos. 1 of the judgment of the court below, were printed out to A4 paper to obtain an amount equivalent to the market exchange value of the above trade secret, and the fact that the damage company caused property damage equivalent to the same amount to the damaged company is not easy, but is disadvantageous to the defendant company.

However, the fact that the defendant confessions the defendant and reflects the defendant's wrongs through detention life for a considerable of ten months, most of the trade secret data of the victim company taken out by the defendant is related to I's hardware, and some of the software-related data include algorithm, design circuit drawings, and software operating code.
