A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

1. 공무집행방해 피고인은 2013. 7. 23. 02:23경 서울 구로구 구로동 1269 중앙하이츠 아파트 정문 앞 도로에서 술에 취해 쓰러져 자고 있던 중 주취자 신고를 받고 출동한 서울구로경찰서 E지구대 소속 경위 F, 경장 G이 피고인을 깨우자 갑자기 위 F 등에게 욕설을 하면서 오른발로 위 F의 오른쪽 정강이를 1회 찼다.

Accordingly, the Defendant interfered with the legitimate execution of duties concerning the protection of the hosts of F, a police officer.

2. 모욕죄 피고인은 제1항 일시, 장소에서 제1항과 같이 피해자인 위 F 등이 피고인을 깨우자 피해자에게 위 G, 피고인의 여동생인 H 및 행인들이 있는 상황에서 “이 개새끼야. 네가 뭔데 날 깨우냐 ”, “개쌔끼야. 좆같은 새끼야”는 등의 욕설을 하였다.

Accordingly, the defendant openly insultingd the victim.

The Defendant alleged that the Defendant’s assertion of the testimony of the witness F and G in each of the statutory statements by the witness F and G did not support the police officer F’s testimony. However, according to the evidence duly adopted and examined by this court, the Defendant is found guilty of the assault crime as to the above F.

Therefore, the defendant's above assertion is not accepted.
