1. The Defendant: KRW 46,782,518 for the Plaintiff and KRW 5% per annum from November 6, 2018 to October 11, 2019; and

1. Facts of recognition;

A. On June 21, 2017, the Plaintiff purchased all houses located in Suwon-si District C.

Around July 2017, the Plaintiff entered into a contract with the Defendant to carry out work on the management of the fixed number of trees, such as replacement of turfs in the fixed number of the above electric power resource housing (hereinafter referred to as “instant fixed number”), and transfer of turfs, such as pine trees, for KRW 11,993,00 (hereinafter referred to as “instant contract”).

The defendant is qualified as a landscape technician and plant industry protection technician, and is a person who has performed landscaping-related affairs for about 20 years in a construction company, such as conducting landscaping-related affairs for about 6 years.

B. Under the instant contract, on July 2017, the Defendant: (a) replaced turfs on the instant garden in the middle and middle order; and (b) performed turf work on tree trees, etc. (hereinafter “instant work”). D.

After the instant work, among the gardening trees planted in the instant garden, 8 glue tree, 1 glue tree, and 1 glue tree (hereinafter “instant pine tree, etc.”) were dead.

2. The plaintiff's assertion

가. 이 사건 소나무 등 고사로 인한 손해 피고는 이 사건 정원의 정원수에 대한 전정을 실시하는 과정에서 적절한 강도로 전정 작업을 수행하여야 함에도 불구하고, 시기에 맞지 않는 강전정 일반적으로 소나무에 대한 전지는 중부지방의 경우 강전정을 해빙기인 2~3월에 실시하고, 그해 가을에는 도장지(徒長枝)와 잔가지를 정리하며, 이듬해에 적심을 함으로써 최종 마무리를 하게 된다(감정서 제3쪽 참조).
