The prosecutor's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal (the factual error) alleged that Defendant A sold 8,349 square meters of I forest land (hereinafter “the forest of this case”) to Defendant A in 120,000 square meters per square meter per square meter in Won-si, which was purchased in 20,000 won per square meter (hereinafter “the forest of this case”), Defendant B and C had been aware of the purchase price of the forest of this case, but Defendant A stated that the above Defendants had known of the price to the above Defendants, and the above Defendants had previously been experienced in the planning real estate company, it is clear that Defendant C made a false statement to avoid liability with the knowledge of acquiring money at a low price. In particular, Defendant C appears to have been involved in the trade of this case, such as attending the field as a long-term answer of K, and Defendant C could not be able to apply for the construction permit and the construction permit exceeding 285 square meters per square meter per square meter per square meter per square meter per square meter per square meter in order to prevent real estate speculation and difficult development.
2. Determination
A. The summary of the instant facts charged from July 2007 to September 201, 2010, Defendant A operated the said company as the representative director of (ju) H, a planning real estate company with the fourth and fifth floors of Seoul Gangnam-gu Seoul Building. Defendant B served as the managing director of the said company from October 2008 to July 2009. Defendant C served as an operating employee of the said company from December 2008 to September 201.
The defendants purchased the forest land of this case in the name of the above company, and invite many and unspecified persons to raise profits from the purchase of the forest land of this case at a low price as if the land price increases due to the development of nearby the forest land, etc., and the above forest land is flat around March 6, 2009.
