1. The Defendant’s KRW 600,000,000 as well as annual 5% from October 31, 2016 to September 27, 2017 to the Plaintiff.
Reasons
Basic Facts
On January 19, 2009, the Plaintiff completed the registration of transfer of ownership with respect to building D (hereinafter “instant real estate”) of Geumcheon-gu Busan (hereinafter “instant real estate”). On February 18, 201, the Plaintiff completed the registration of transfer of ownership with respect to building F (hereinafter “instant F real estate”).
7.Matters other than this Agreement and any special agreement shall be in accordance with general practices.
Any dispute shall be subject to arbitration in the competent court or G.
(Special Agreement) ① Payment of 80 per cent of the total amount under the contract and the balance shall be made at the time of the payment of the balance.
(2) A seller's daily amount of KRW 100 million out of the purchase price shall be adjusted, while a daily amount of KRW 100 million shall be adjusted according to the retirement benefits (including retirement allowances) and H-friendly borrowed funds.
(3) A corporation shall require the submission of bonds and related documents so that a corporation may exercise the right to indemnity against a loan out of its funds for business purposes, and the legal issues pertaining thereto shall cooperate with each other.
4. All contracts concluded prior to the date of this contract shall be recognized to have been in violation of I and B.
6. Since the buyer has violated several times of contract, he/she shall pay to the seller at the date of execution of this contract the daily amount of the provisional contract shall be paid, and if the purchase price is not paid within three months from the date of execution of this contract, the said provisional contract shall revert to the seller.
8. This contract shall be effective for a period of three months, and since it is concluded at the request of the buyer in good faith, the buyer confirms that the seller will not raise any civil or criminal problem against the contract.
(9) It is confirmed that B does not raise any objection against the KRW 1.1 billion in a civil or criminal manner.
On February 19, 2016, the Plaintiff concluded a sales contract with the Defendant to sell the instant heading D, and F real estate in KRW 1,100,000 (hereinafter “instant sales contract”).
