1. However, in fact, the Defendant did not intend to conclude a “AY” acquisition contract with the Z for the victim and planned to use the money individually as the acquisition price. Thus, even if receiving the money from the victim, the Defendant did not have any intent or ability to have the victim acquire and operate the “AY”.
Nevertheless, on February 26, 2018, the Defendant deceiving the victim as above and received KRW 18,000,000 from the victim to the R account under the name of the Defendant as the contract deposit for acceptance of “AY” around February 26, 2018, and then, from around that time to July 4, 2018, by deceiving the victim by the above means from the Busan Sin-si to the Busan Sin-si, and by deceiving the victim through the above means, and by taking the total of KRW 122,780,00 in the name of the acquisition price for “AY” as shown in the attached crime list.
2. On February 26, 2018, the victim of the forgery of a private document or the uttering of a private document received a proposal from the Defendant to take over the “AY” house from the Defendant, and transferred KRW 18,000,000 to the R account under the name of the Defendant as the contract deposit for acceptance of the “AY”, and directly prepares a sales contract by using the computer, and “the sales contract” as “the indication of real estate” in the “sales contract” column is “the location: the Busan Metropolitan City Shipping Daegu.”
