1. The Defendants are jointly and severally and severally liable to the Plaintiff for 1,970,353,149 U.S. dollars 2,563,294.92, and 208,239,138 U.S. dollars.

A. Foreign Exchange Bank Co., Ltd. lent money to Defendant A Co., Ltd. (hereinafter “Defendant A”) as listed in the following table, and Defendant B jointly and severally guaranteed Defendant A’s above loan obligations up to KRW 500,000,000.

B. On September 29, 1998, the Foreign Exchange Bank Co., Ltd. transferred each of the above loans against Defendant A to the Plaintiff, and notified the Defendant A of the assignment on the same day.

C. The Plaintiff filed a lawsuit with the Daejeon District Court 2004Gahap2186 against the Defendants seeking the performance of each of the above loans and the joint and several surety obligations.

On December 2, 2004, the above court below held that US$ 1,243,763,965 and US$ 912,590.02, among them, US$ 561,401,00 and US$ 741,33.96 shall be applied to the plaintiff.
