A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On October 5, 2012, the Defendant made a false statement to E, an employee of the said company, at the victim-type C apartment site office located at the victim-type C apartment site site, stating that “The price of the electric equipment purchased at D is lower than that of the electric equipment purchased at D, and the Defendant would pay the material purchase price 60 days after the receipt of the electric equipment to be used within another construction site at the time of purchase.”
However, the defendant was more than 10 years after he became a person with bad credit standing at the time, and the credit card was 40 million won due to his personal debt, and it was in a situation in which electrical construction cannot be properly carried out at the construction site due to the absence of a certain amount of income, and there was no intention or ability to pay the price at a fixed date even if he was supplied with the electrical construction from the victim.
The Defendant was supplied with electric equipment equivalent to 14,159,750 won, including 50 electric wires (CV) with a unit price of 7,330 won on October 15, 2012; total of 10,364,585 won; total of 350 electric wires (CV) with a unit price of 11,312 won around October 1, 2012; total of 16,671,60 won; total of 300 electric wires with a unit price of 20,670 won; total of 30,671,600 won; total of 30; total of 30,50,600 electric wires; total of 16,671,600 won; and total of 30,50,506,000 electric wires and equipment equivalent to 20,57,000 won; and total of 36,536,065,065,55, etc.
Accordingly, the defendant was given property by deceiving the victim.
