A defendant shall be punished by imprisonment for not less than three years and six months.

The defendant shall be ordered to complete 40 hours of sexual assault treatment program.

Punishment of the crime

1. On June 17, 2019, the Defendant violated the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. 2. 강간상해 피고인은 전항 기재 일시, 장소에서 전항 기재와 같이 피해자 D(가명, 여, 41세)와 콘돔을 착용하고 성관계를 하던 중, 갑자기 콘돔을 제거하고 피해자의 음부에 성기를 삽입하려 하여 피해자로부터 “콘돔을 끼우지 않으면 성관계를 할 수 없다”는 말을 듣자 화가 나 한 손으로 피해자의 목을 잡아 당겨 피고인의 성기를 피해자의 입 안으로 집어넣으면서 “내가 너를 돈 주고 샀는데 이 정도도 못참냐 ”라고 하면서 손으로 피해자의 팔을 뒤로 꺾은 후 손바닥으로 피해자의 엉덩이 부위를 수회 때리고, 저항하는 피해자의 음부에 손가락을 집어넣어 휘저은 다음 피고인을 피해 달아나는 피해자를 잡아 다시 팔을 뒤로 꺾고 손바닥으로 피해자의 엉덩이 부위를 수회 때리고, 계속하여 피해자를 침대 위로 밀친 후 콘돔 없이 피해자의 음부에 성기를 삽입한 후, 피해자의 항문에 피고인의 성기를 삽입하려고 하였으나 피해자가 아프다고 하면서 저항하여 삽입하지 못하였다.
