A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2019 Highest 1322"

1. On March 22, 2019, the Defendant violated the Act on Special Cases Concerning the Settlement of Traffic Accidents (Bodily Injury) driving the said trucks without obtaining a driver’s license for driving the said trucks on the front three-distance road located in Gumi-si B, Gumi-si, thereby driving them from the seat of the DF Feed Factory to the e elementary school.

There is a place where overtaking is prohibited as a private distance intersection where no signal, etc. is installed. In such a case, there was a duty of care to avoid overtaking a person driving a motor vehicle through the intersection.

Nevertheless, the Defendant neglected this and went through without a driver’s license while driving a vehicle without a driver’s license, and was negligent in overtaking the Victim F (year 51) G New Scki’s bus going ahead of the intersection, and received the front part of the said bus’s left side side.

Ultimately, the Defendant suffered injury to the two parts of the victim, which requires approximately two weeks of medical treatment, due to the above occupational negligence.

2. No person who violates the Road Traffic Act (licensed driving) and the Guarantee of Automobile Accident Compensation Act shall operate any motor vehicle on a road which is not covered by mandatory insurance;

The Defendant was driving the said truck, which was not covered by mandatory insurance without obtaining a driver's license from around 500 meters in a section of 500 meters from the roads near the E Elementary School located in Si/Gu, Si/Gu, Si, si, to C, C.

1. No automobile which is not covered by mandatory insurance in violation of the Guarantee of Automobile Accident Compensation Act shall be operated on a road;

Nevertheless, at around November 23, 2019, the Defendant operated the said cargo vehicle on the roads prior to the J's “J” located in Gyeong-si, Chungcheongnam-si, North America on November 23, 2019, which was not covered by mandatory insurance.

2. The defendant who violated the Road Traffic Act (unlicensed Driving) shall temporarily remain in the border of the city as provided in paragraph (1).
