피고인은 2016. 7. 2. 21:35경 부산 사하구 B에 있는, C식당에서 피고인 등 3명이서 술을 마시며 오리고기를 구워 먹고 나서 피고인 일행이 홀 서빙 하던 피해자 D(여, 20세)에게 밥을 볶아 먹고 남은 것을 포장해 달라고 하여 피해자가 사각테이블에 앉아 있던 피고인 옆에서 포장하고 있을 때 “아가씨”라고 부르면서 겨드랑이 아래 가슴을 손으로 툭툭 치며 “바쁜데 포장해 달라고 해서 귀찮제”라며 재차 엉덩이를 손으로 툭 치며 쓸어내리듯이 만지는 방법으로 강제추행 하였다.
