Defendant

On April 27, 2016, from around 16:00 to 16:50, A had been engaged in the swimming business, such as the victim H (age 6) while running the swimming business within a swimming pool with the highest depth of 130 cm in a swimming pool located in the instant sports center, and with the swimming business with the “string class”, and Defendant B and C had maintained the safety of students, such as the victim, while serving as safety personnel in the swimming pool from around 16:00 to 17:00 on the same day.

However, the class is in progress in water, and it is in progress in the adult pool that can only enter adults, and there was a higher risk of an accident, and in particular, if a young student who has failed to take care of his/her body in the water speed falls into water or suffers bodily or pulmonary disorder without leaving his/her body in the water speed, and there was a high risk of suffering from pulmonary disorder due to the lack of the ability to seek help. Therefore, the Defendants had a duty of care to prevent a young student from entering the adult pool or to guide and supervise the ordinary safety personnel in charge of safety rules and working methods.

Nevertheless, the Defendants neglected to do so, and Defendant A has the safety rules and regulations for the ordinary safety personnel.
