1. Basic facts

A. On January 6, 2011, the Defendant: (a) prepared a power of attorney to authorize the Plaintiff to prepare a notarial deed (hereinafter “instant power of attorney”); and (b) on the same day, a notary public submitted the power of attorney at the Multiury Office to the attorney-at-law in charge of authentication in the law firm office to submit the instant power of attorney-at-law in charge of authentication; and (c) as the Plaintiff’s agent and obligee, a notary public who borrowed KRW 85,00,000 on June 30, 201, stating that “the Plaintiff, who is the obligor, borrowed from the Defendant, who is the obligee, and was immediately subject to compulsory execution if the obligor fails to perform the said obligation, he/she shall be deemed to have no objection thereto even if he/she is subject to compulsory execution.”

B. On June 1, 2012, on the basis of the instant notarial deed, the Defendant filed an application for the commencement of compulsory auction with the Jung-gu District Court on the land and its ground, D land, and E land (hereinafter “Plaintiff-owned real estate”) owned by the Plaintiff on June 1, 2012, and rendered a decision to commence compulsory auction on the fourth day of the same month.

C. The Plaintiff and the Defendant: (a) written confirmation of the following (hereinafter referred to as “instant confirmation”; and (b) written confirmation of the contents agreed by the said written confirmation (hereinafter referred to as “instant agreement”); and (c) was authenticated by a notary public as a deed signed by a private person (No. 832, 2012).

1) The Plaintiff and the Defendant withdraw all the civil and criminal cases currently in progress. The Defendant’s withdrawal of the complaint, such as fabrication of private documents, is Finbu District Court .
