1. The Plaintiff:

A. The defendants are indicated in the annexed drawings in Yangyang-gu, Yangyang-gu, Yangyang-gu, as one of the following: (1), (2), (3), (4), and (1).

1. Facts of recognition;

가. 원고와 피고 A 사이의 전문점 운영계약 체결 원고는 한국철도공사로부터 역 구내 사용승인을 받아 고양시 덕양구 B역 맞이방 내 별지 도면 표시 ①, ②, ③, ④, ①의 각 점을 순차로 연결한 선내 ㈎ 부분 점포 60.95㎡(이하 ‘이 사건 점포’라 한다)를 설치한 후, 2014. 1. 1. 피고 A과 사이에 위 점포에 관하여 계약기간 2014. 1. 1.부터 같은 해 12. 31.까지로 정하여 다음과 같은 내용의 전문점 운영계약(이하 ‘이 사건 전문점 운영계약’이라 한다)을 체결하였다.

Article 15 (Access Authority to Sales, Confirmation of Registration of Sales of POS Terminals, and Inspection) (2) The plaintiff permitted to enter the sales outlet may frequently check and check whether the sales through the POS terminal installed in the sales outlet is faithfully implemented as at the time of sales.

Article 25 (Management of Sales and Payment of Sales Proceeds) (3) In managing sales by the POS sales system, an amount equivalent to 90% of the monthly estimated sales presented by the Defendant in the business proposal shall be determined as “minimum monthly sales”.

Article 26 (General Cost) (1) The plaintiff shall pay 77% of monthly sales (including value-added tax) to the defendant as a comprehensive comprehensive cost (including product cost, personnel expenses, direct expenses, and corporate profits).
