The judgment of the court below is reversed.

Defendant shall be punished by a fine of KRW 300,000.

The above fine shall not be paid by the defendant.

1. According to CCTV images at the time of the appeal, the court below found the Defendant guilty of the facts charged in this case, which erred by misunderstanding the facts and adversely affecting the conclusion of the judgment, even though the Defendant did not have taken the victim's hand and carried the victim's face with the debt taken by hand.

2. Prior to the judgment on the grounds for appeal by the defendant ex officio, prior to the judgment on the grounds for appeal by the defendant's ex officio, the prosecutor's name of the crime against the defendant was examined as "Assault", applicable provisions of law as "Article 260 (1) of the Criminal Act", and the facts charged against the defendant was revised to the effect that "the defendant was unable to maintain any further judgment of the court below which is based on the initial facts charged, since the defendant was changed to the effect that "the defendant did not have a proper intention despite the victim C's having taken an action by hand on March 3, 2014, at the Korean bank high-Eup/Eup/Myeon, the defendant did not have a proper intention."

However, the defendant's assertion of misunderstanding of facts is still subject to the judgment of this court (the defendant asserts that "the defendant only left the victim by putting the victim with the changed facts, and there is no fact that she was sealed towards the wall).

3. The following circumstances acknowledged by the evidence duly adopted and investigated by the court below, i.e., CCTV images at the time of the instant case, i.e., (i) the victim, who was faced with the door of the bank at the time of the CCTV image, was faced with the door and was seated, and the Defendant, who followed it, was found to have carried the part of the victim’s shoulder and pushed down with the wall by hand.
