A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Criminal facts
1. The Defendant is a person who is engaged in driving a rocketing car in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes.
On October 16, 2014, the Defendant driven the said vehicle under the influence of alcohol of 0.136% on blood alcohol level 0.16% on October 22, 2014, and continued to drive the said vehicle along the three-lane road in front of the motor vehicle driving in the Goyang-gu, Goyangyang-gu.
At the time, a person engaged in driving a motor vehicle at night and at a place where a signal, etc. is installed, has a duty of care to safely drive the motor vehicle by checking well the front side.
Nevertheless, under the influence of alcohol, the Defendant’s negligence neglecting the front-time of the driver’s license, caused the part of the driver’s license of the Defendant’s driver’s license to the front-time part of the driver’s license of the Defendant, which was driven by the victim C (the 43-year-old driver’s license) of the driver’s license of the Defendant’s license of the driver’s license of the driver’s license of the victim E (the 42-year-old driver’s license of the driver’s license of the driver’s license of the driver’s license of the driver’s license of the driver’s license.
As a result, the Defendant was driving in a state where normal driving is difficult due to influence of drinking, and the Defendant suffered injury to the victim C, such as tensions, tensions, etc., and approximately two weeks of medical treatment to the victim E, respectively.
