1. The Defendant: (a) KRW 30,250,000 for the Plaintiff and 5% per annum from November 24, 2016 to November 15, 2017; and (b) the Plaintiff.
Reasons
1. On July 2, 2012, the Plaintiff entered into a construction contract with the Defendant with respect to the internal team construction works among the new factory construction works (hereinafter “instant construction works”) as follows.
The project owner: The name of the principal contract for the resolution of the conflict of accounts: The name of the subcontractor for the new construction of a factory in Cululty Bioscience B: the contract amount on September 30, 2012: the contract amount on July 20, 2012: 3,494,700,000 won: the warranty period on December 14, 2012 after the completion of the principal contract of this case by the principal contractor: the Plaintiff and the Defendant changed the construction period to October 31, 2012, and reduced the contract amount to KRW 2,664,20,000.
The Plaintiff and the Defendant reserved KRW 101,200,000 out of the construction cost at the time of completion of the said construction in lieu of the warranty bond.
The instant construction defect liability period was terminated on October 31, 2015, and the Defendant offseted the following amount out of KRW 101,200,000 on November 4, 2015, and paid KRW 38,392,617 to the Plaintiff.
