The plaintiff's claim is dismissed.

Litigation costs shall be borne by the plaintiff.

1. 【Evidence of Basic Facts】 1-1, 2, 2, 3, 4, 17, the purport of the whole pleadings;

A. The plaintiff is the representative director of D (hereinafter referred to as D) who mainly aims at software consulting, development and supply business, etc.

Defendant C (hereinafter “Defendant C”) is a company whose main purpose is to sell and manufacture survey instruments, and survey software development business, etc., and Defendant B is the representative director of the Defendant Company.

B. The registration of the Plaintiff’s computer program work (1) on June 2, 2001, the Plaintiff registered “E” and “F” (hereinafter collectively referred to as the “instant program”) with the author as the Plaintiff at the Korea Software Promotion Agency.

(2) The instant program is a program developed to measure the measurements of large blocks in three-dimensional ways when building a ship or a marine structure. It is possible to conduct a three-dimensional multi-level survey if the instant program is linked to the dye (PDA, person dyeants) equipped with the instant program on the optical wave, which is a survey machine.

C. Defendant B’s act, while operating the Defendant Company, sold the luminous wave from H, the Plaintiff’s father, and the Plaintiff’s H, supplied to the Shipbuilding, along with the PEA equipped with a program capable of three sources of multi-level surveying from around 2003 to the present day.

After the process of copyright dispute mediation, the plaintiff applied for mediation of the damage compensation dispute by the third multi-level survey program sold by the defendant company to the program deliberation and resolution committee in the name of D on July 2006.

In the above dispute mediation procedure, Defendant B entered H and jointly developed the instant program with the Plaintiff and C, and supplied and sold the instant program and PDA from the Plaintiff. The problems and hardware of the program are the Plaintiff.
