A has been operating F Co., Ltd. and G Co., Ltd. operating overseas travel business, etc.
【Crimes by Defendants 2017 Godan 2770】
1. Defendant A’s crime;
A. On April 2015, the Defendant: (a) at the office of the F Co., Ltd. located in H and the third floor in Jung-gu Seoul, Jung-gu; and (b) at the office of the F Co., Ltd., the Defendant, including I, who reported and contacted travel goods advertised through the Central Library, sent 5-day Spanish travel to six victims.
However, the facts are that each of the above travel agencies operated by the defendant at the time, even if they receive the travel expenses from the above victims due to aggravation of management conditions and pressure of funds, they cannot be used as advertising expenses or operating expenses, etc. of each of the above travel agencies. Therefore, they cannot be used as the travel expenses for the above victims, and there was no intention or ability to provide the travel services agreed to the above victims.
As above, the Defendant: (a) by deceiving the said victims; (b) obtained KRW 2,400,000 from the said victims on April 20, 2015, and (c) around May 20, 2015, KRW 7,800,000 from the said victims to the Daegu Bank account in the name of F; and (b) acquired KRW 10,20,000 in total from the said victims to the Daegu Bank account in the name of F.
In addition, from that time to March 6, 2017, the Defendant, as shown in the attached Table 1 Table 1, deceiving victims on a total of 31 occasions as above, and took each of them by receiving the total of 143,020,500 won from the victims as travel expenses.
B. On December 2016, the Defendant: (a) received a demand from a police officer belonging to the Gangnam-gu Seoul Metropolitan Police Station to attend a meeting to the effect that “I would like to investigate the case of fraudulent complaint related to travel expenses filed by 24 persons, including K, who are J Su-gu customers; and (b) on December 7, 2016, with relevant supporting materials and to attend the meeting; (c) around the 5th day of the same month, the Defendant would be the Seoul Gangnam-gu L and G office of G Co., Ltd.; and (d) M Co., Ltd.
