A defendant shall be punished by imprisonment for three years.

The defendant shall complete the sexual assault treatment program for 80 hours and shall be a child or juvenile.

Criminal facts

1. Around March 25, 2018, the Defendant, who violated the Act on the Protection of Children and Juveniles against Sexual Abuse (production, distribution, etc. of obscene materials), took pictures using a Handphone (LG 530), owned by the Defendant, while engaging in sexual intercourse with the victim E (the 17-year age, the 17-old and household name) who is a child or juvenile, known through Internet D at the Defendant’s residence located in Dongdaemun-gu Seoul building C.

In addition, the Defendant produced 17 child and juvenile pornographys on a total of four occasions from November 25, 2017 to March 25, 2018 in the same manner as in the attached list 1.

2. From February 6, 2018 to May 8, 2018, the Defendant, in violation of the Act on the Protection of Children and Juveniles against Sexual Abuse (production, Distribution, etc. of obscenity) and the Act on the Punishment, etc. of Sexual Crimes (hereinafter referred to as the “Camer, etc.”) received KRW 1.7 million from F, which was known through Internet D at the site of the Internet from around February 6, 2018, and sold 25 sexually related videos with 17 sexual pornographys and G (the age 27) which could cause sexual humiliation or shame as described in paragraph (1).

In addition, from February 6, 2018 to June 11, 2018, the Defendant received total of 2,90,000 won from total of three persons, such as the entry in the list of crimes in attached Table 2, and sold child and juvenile pornography, and at the same time sold sexually related videos against the will of the persons subject to filming.

3. A defendant who has violated the Act on the Punishment, etc. of Sexual Crimes (Ameras, Use and photographing) from March 6, 2018;

3. From July 1, 200 to July 200, he received 400,000 won from a person under whose name the account holder used the name of “H”, and sold 19 sexually related video images against the will of G (the age of 27) which may cause sexual humiliation or shame.

In addition, the Defendant received total of KRW 1.7 million from four persons, as shown in the attached Table 3, from June 14, 2018, as well as from that time until June 14, 2018.
