A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On February 19, 2013, the Defendant was sentenced to 8 months of imprisonment with prison labor and 2 years of suspended execution for the crime of false accusation in the Incheon District Court Branch of the Incheon District Court, and the judgment became final and conclusive on February 27, 2013.
1. On January 19, 2013, the Defendant, at around 20:20 on January 19, 2013, while drinking alcohol together with D and victim E in a plan for the collection of the Defendant of Yangcheon-gu Seoul Defendant, Yangcheon-gu, Seoul, the Defendant: (a) took a dispute with the victim; (b) took a part of the victim’s title; (c) assaulted the victim’s face to an empty baby, which is a dangerous object on the floor of the victim; (d) assaulted the victim.
2. 피고인은 같은 날 21:10경 제1항 기재 사건으로 현행범으로 체포되어 서울 양천구 F에 있는 G파출소로 이동한 다음, 위 E, D, 위 파출소 경찰관 등 10여명이 있는 자리에서 위 파출소 소속 경찰관인 피해자 H과 피해자 I으로부터 신분증 제시를 요구받자, 피해자들에게 “느그들이 알아서 뭐해. 야 씹할 놈아. 쌍놈의 새끼들. 개새끼들. 병신같은 것들. 느그들 모가지 언젠가는 떨어진다. 니미 씹보지 팔아먹어라. 좆만한 새끼들. 대한민국 경찰 개새끼들. 좆삐리만한 놈새끼. 니미 보지 같은 소리하지마. 니는 씹할 갔다 와서 한번 보자. 목을 따줄 테니까. 니미 씹할”이라고 욕설하여, 공연히 피해자들을 모욕하였다.
3.
