Punishment of the crime
Defendant
A from February 2, 2013 to December 31, 2014, from Gangwon-gun, a village transfer from Gangwon-gun to Gangwon-gun, Defendant B, a village manager in the same period of time, and each village fund management business, etc. A was in charge of the management of the funds of the D Farming Cooperatives established by residents of the village (the head of the village, the head of the general government, and the head of the association).
1. On July 18, 2014, Defendant A received KRW 72,250,000 from 72,250,000 from Do resident’s joint ownership and received from Do resident’s account under the name of Do Agricultural Cooperatives to deposit to Do Agricultural Cooperatives (E) and kept it for the said association’s business purpose. On October 17, 2014, Defendant A voluntarily withdrawn KRW 50,000 out of the above money from Dogwon Jong-gun’s home located in Dogcheon-gun F and embezzled it for personal purposes, such as purchase price.
2. On April 4, 2014, Defendant B used KRW 150,00,00,000 for personal purposes, while keeping the amount of Buddhist village funds in cash for the village residents of the damaged village at the home of the Defendant’s house located in Gangwon-gu, Gangwon-gun G.
The Defendant embezzled the village fund kept in cash from that time to December 31, 2014 by using it for personal purposes over 18 occasions, such as the list in the annexed list of crimes.
3. On March 5, 2014, the Defendants embezzled one table to their respective houses while purchasing five tables from the village welfare center located in Gangwon-gu Seowon-gun C with the village fund in the amount of KRW 220,000,00 in the market value and storing for the village residents of the damaged.
