1. Of the judgment of the first instance, the part concerning the claim against the Defendant F and the claim against the Defendants in the Plaintiff B.
Reasons
1. Basic facts [Evidence] Gap evidence 1 through 5 (including branch numbers in the case of additional numbers; hereinafter the same shall apply) and the result of an order issued by the first instance court to submit financial transaction information to M Co., Ltd. on July 5, 2018, the result of the appraisal by this court appraiser Q, the purport of the whole pleadings;
A. 1) The deceased J and the deceased K are married couple, and the deceased J died on September 19, 201, and the deceased K died on April 7, 2015. 2) The Plaintiffs and the Defendants are registered as the deceased’s children in the family relations register.
B. On March 12, 2002, the deceased’s donation to the Defendants, etc. 1) on March 12, 2002, the deceased K completed the registration of ownership transfer on the I’s housing on the ground of donation on March 11, 2002, and on May 2, 2003, the deceased J completed the registration of ownership transfer on the H’s housing on the ground of donation on May 2, 2003. The value of H residential and I’s housing was as indicated below the “value at the time of commencement of inheritance” as stated below at the time of commencement of each inheritance of the H’s housing. The value of the H residential and I’s housing was 1H J. 7, 203, 174,790,280 won on May 2, 2003, 207, 203, 30, 205, 36, 208, 45, 2015.
2. The plaintiffs' assertion
A. On May 2, 2003, the primary claimJ infringed on the legal reserve of inheritance of the deceased K and the plaintiffs by donating H housing to Defendant F.
The legal reserve of inheritance that the deceased K can demand the return to Defendant F is 3/34 shares, and the legal reserve of inheritance that the plaintiffs can demand the return is 2/34 shares, respectively. Since the deceased K's legal reserve of inheritance 3/34 shares are inherited 1/7 shares to the plaintiffs, the legal reserve of inheritance of the plaintiffs is 1/14 [=2/34 (3/34 x 1/7] shares.
