Reasons
1. Basic facts
A. Both construction companies (hereinafter “bridge construction”) and Defendant and four other companies are the members of a joint supply and demand organization (hereinafter “instant joint supply and demand organization”) that receives a contract for construction works of HS, South High-speed Speed No. 4-2 Section, Nowon-gu Speed No. 4-2 Section, and other construction works (hereinafter “instant prime contractor”) ordered by the Korea Rail Network Authority by joint performance method, and the Plaintiff is the subcontractors who received a contract for the fence and railing works (hereinafter “instant fence construction”) from the representative of the instant joint supply and demand organization (hereinafter “the instant joint supply and demand organization”).
B. Around October 2011, the Plaintiff entered into a contract to accept the instant fence construction and the instant fence. After that, the Plaintiff and Duna Construction concluded a contract to change the construction cost on several occasions and finally set the construction cost at KRW 1,621,13,140.
